Our online platform allows you to design a personalized workout experience tailored to your fitness goals. Start by selecting the equipment you have available, whether it’s bodyweight, dumbbells, barbells, kettlebells, resistance bands, weight plates, a pull-up bar, or a bench. Next, choose your training focus by selecting the specific muscle group you want to work on, such as arms, legs, back, chest, or core. Finally, customize your workout by adjusting the duration, intensity, and specific exercises to fit your preferences and skill level. Once you're satisfied with your personalized routine, you can save and track your progress over time. These Terms of Use underlines the rules and regulations for the use of ZeFitBlad owned by ZENIBLEND LIMITED. By accessing and Subscribing to our Services you acknowledge that you are at least 18 years, you reside in one of the countries where ZeFitBlad operates and you accept this Agreement in full. You should not use our Services if you do not accept all of the terms stated on this page including our Privacy Policy which is integrated into this Agreement and is legally binding to all partied involved.

2. ZeFitBlad CONTENT

   You have the capability to access and download all of ZeFitBlad content (including but not limited to text, video, audio) which is curated and presented by us and third-party providers. You acknowledge that ZeFitBlad does not guarantee the accuracy, completeness, or appropriateness of the website’s content and you have to use it with caution as it might be harmful, incorrect, or misleading. ZeFitBlad does not bear responsibility to monitor such content and retains the right to edit and/or delete any documents, information, or other content appearing on the site. ZeFitBlad. You also acknowledge that ZeFitBlad's Social Media Pages presented to the website are hosted on third-party websites and are governed by their Agreements and ZeFitBlad beard no responsibility for any claims due to your use or inability to use the Social Media Pages.

3. REGISTRATION

   To access certain Services, you may be required to complete a registration form providing accurate and current registration data such as your name, email address, phone number, billing address and credit card details (if purchasing Membership). The person who has access to the email address provided to the form will be considered as the owner of the Membership and you acknowledge that the provided card, billing and payment information are legitimate and not stolen. If you want to change your user details and payment methods, sign in and go to "My Account". Further, you are responsible to any consequence arising from the usage of your account and to ensure the payment of your invoice each billing cycle until the cancellation and/or termination of your Membership.

4. FEES & PAYMENTS

   Before proceeding with the registration please be sure that you're paying the accurate price for your Membership considering the country where you're registering according to the below list. If you note any mistake, contact our Customer’s Support Team.

   All payments are conducted in your local currency and/or the local currency of United Kingdom via Visa’s and/or Mastercard’s credit card and/or debit card and/or PayPal account and/or other payment method through an SLL encrypted connection, ensuring the highest level of security. The processing of payments may be conducted by third payment processor and/or acquirer and we bear no responsibility for their actions.

5. MEMBERSHIP

   5.1 Trial Period

   By registering for a Membership, you agree that ZeFitBlad will deduct the trial period fee disclosed to the campaigns and subsequently charging the complete recurring fee from the credit card you initially used to continue the Service. After the trial period, your Membership will be renewed automatically based on the plan you will choose to your local price or the local price of ZeFitBlad country without further authorization for the recurrent payments. Upon receipt of your order, ZeFitBlad will grant access to the purchased services as per the relevant terms.

   5.2 Emails

   A welcome email from our company will be sent to you upon your registration. Further, a confirmation email detailing the billing information for your order will be sent to the email address provided by you. We retain the right to issue digital or physical invoices and all communication will be conducted electronically or via phone. If you have any inquiries about the delivery of your order or if you have troubles receiving any of our emails, please reach out to us at [email protected] or contact our customer’s support team. We will also notify you by a reminder email with the date and time of the expiration of the trial period, the billing information and this Agreement 7 days before your trial period expires, or immediately after the purchase (in the confirmation email) if the trial period is less than 7 days. You bear responsibility to ensure the availability of your email and ZeFitBlad will not be liable for any failure to receive them.

   5.3 Billing Cycle

   Your Membership fee will be deducted on the specified payment date mentioned in the Reminder Email. The duration of your billing cycle will vary depending on the Membership type you selected when registering. Your payment date may change if your payment method has not successfully settled or if you change your subscription plan. You authorize ZeFitBlad to retry and collect at a later time any unpaid fees by you. We have the sole discretion to provide a discount on a subscription payment plan without giving any prior notice.

6. CANCELLATION OF MEMBERSHIP

   If you are dissatisfied with your purchase, you have the option to cancel your Membership with ZeFitBlad at any time. You can do so by clicking "Cancel Subscription" and following the provided instructions, or by reaching out to our customer support team via email/phone. Upon cancellation, your account will remain active until the next billing cycle.

   You agree that ZeFitBlad has the right to cancel your Membership without further notice if your payment is not successfully settled because of expiration of your card or due to insufficient funds until your payment method can be processed. Finally, you acknowledge that while your Membership remains active and/or has not been cancelled or terminated, you are responsible for the outstanding amounts.

   The clauses in these Terms of Use relates to the intellectual property, disclaimers and warranty, indemnification, liability limitations, and governing law will persist even after the cancellation of your Membership.

7. TERMINATION OF MEMBERSHIP

   All clauses of this Agreement are material and breach of any clause by you (including but not limited to the privacy policy and anti-money laundry policy clause) gives the right to ZeFitBlad to terminate your Membership to the services at any time without any notice. You agree that ZeFitBlad has the right to terminate your Membership without further notice if your payment is not successfully settled because of expiration of your card or due to insufficient funds. Finally, your Membership can be terminated if your usage of our Services violates any applicable laws and/or is involved with illegal, fraudulent and unethical activities and/or poses risk to other users and/or ZeFitBlad.

   The clauses in these Terms of Use relates to the intellectual property, disclaimers and warranty, indemnification, liability limitations, and governing law will persist even after the termination of your Membership.

8. REFUNDS

   ZeFitBlad provides a full refund of the paid fee if it is requested within 14 days of your purchase. After the period of the 14 days, you are not allowed to receive any refund for your paid Membership fees even upon termination and/or cancellation of your Membership. You acknowledge that you remain responsible for any remaining charges before the cancellation and/or termination of your Membership. Special considerations can be granted on an individual basis, subject to the discretion of the customer support team.

9. ANTI-MONEY LAUNDRY POLICY

   ZeFitBlad adheres to the relevant anti-corruption, anti-bribery, and anti-money laundering laws, and you acknowledge the obligation to comply with all domestic, federal and European applicable laws as well as to legally binding regulations and UN Conventions.

10. DATA PROTECTION & PRIVACY POLICY

    Certain aspects of our services necessitate the collection and utilization of personally identifying information by us or third-parties, such as data related to the users or activities, or navigation conducted by users through our Services. You acknowledge that all data and material you submit through or in connection with our Services, such as Registration Data and Feedback, are governed by the Privacy Policy, Cookies Policy and Data Collection Policy an upon cancellation and/or termination of your Membership, the user account, operational data, and content will be permanently deleted and cannot be restored.

11. MEMBERSHIP LICENSE

    With your Membership you grant a revocable, non-transferable, non-exclusive, and limited license to access and use our Services and you acknowledge that ZeFitBlad has the right to terminate your license for any reason. Your usage of the Site Offerings is restricted to personal, non-commercial purposes and you agree not to engage in actions that could harm the reputation and goodwill of ZeFitBlad or expose ZeFitBlad or its users to any form of harm or liability, not to violate the privacy rights or any other rights of other users, and refrain from collecting personally identifiable information about users without their explicit consent. Further you agree to avoid purchasing search engine or other pay-per-click keywords or domain names that ZeFitBlad utilizes, to refrain from using any of the ZeFitBlad services for spam, unsolicited communication, fraudulent activities, scams, pyramid schemes, or any form of unethical marketing or advertising and to access ZeFitBlad services solely through publicly supported interfaces provided by ZeFitBlad, and do not attempt to test the vulnerability of ZeFitBlad services or its network through unauthorized means or technologies.

    You acknowledge that the reproduction, modification, downloading, adaptation, renting, leasing, selling, emulation, cloning, decompiling, disassembling, reverse engineering, or transferring of any portion of the Services is prohibited. Moreover, you agree to avoid creating any derivative works by altering any aspect of the Service or using them in conjunction with third-party content and to refrain from uploading, submitting, or displaying any content or using licensed content in a manner that could be construed as malicious, unlawful, defamatory, hateful, libelous, obscene, harassing, threatening, provocative, abusive, racist, offensive, deceptive, or fraudulent.

    You agree to avoid engaging in phishing activities and encouraging criminal or harmful conduct or engaging in any activity that violates any law or infringes upon the rights of ZeFitBlad or any third party, including but not limited to intellectual property rights, privacy rights, copyrights, trademarks, contractual or fiduciary rights. Additionally, you agree not to impersonate any person or company with false information or portray any person, entity, or brand in a disparaging light without their prior explicit approval.

    Finally you should refrain from using any illegal means to collect data, passwords for other websites, third parties, or services and you should not use any "robot" or other automatic device or algorithm to access, copy, or monitor the ZeFitBlad services, including data and content, or replicate the navigational structure of the services. You are not allowed to remove or tamper with any copyright notices, restrictions, or signs indicating proprietary rights you should abstain from accessing or using the services with the intention of building a competitive product and you agree to exercise caution to avoid disabling or otherwise circumventing any measures employed to restrict access to ZeFitBlad services.

12. INTELLECTUAL PROPERTY

    The content offered by the ZeFitBlad service, encompassing video, graphics, design, images, artwork, audio, text, documents, digital conversions, copyrightable materials, methods, algorithms, data, inventions, trade secrets, logos, domains, trademarks, trade names, titles, software, services, and other associated elements, are all subject to relevant intellectual property rights, copyrights, and trademarks.

13. REPRESENTATION AND WARRANTIES

    Our Services are presented on an "As Is," "with all faults," and "As Available" basis, without any guarantees or warranties of any kind. This includes implied warranties or conditions of merchantability, non-infringement of intellectual property, fitness for a particular purpose, uninterrupted use, timely delivery, secure operation, error-free performance, freedom from harmful components, accuracy, reliability, or any educational benefit, success, achievement, or any other warranty – all to the fullest extent permitted by law. ZeFitBlad does not assert or warrant that the Services are complete, accurate, of a certain quality, reliable, or secure in any way. They may not be suitable for or compatible with your contemplated activities, devices, operating systems, browsers, software, or tools (or remain as such over time). There is no assurance that they comply with any applicable laws (including in any jurisdiction in which you operate) or that their operation will be free of viruses, bugs, other harmful components, or program limitations.

    You acknowledge and agree that ZeFitBlad is not liable for the availability of any underlying internet connection associated with the website offerings and cannot held liable if you cannot access its services during periods of peak demand or due to malfunctions in the system for any reason. Further ZeFitBlad will not be held responsible for any damages arising from your use of the Site Offerings or any other services provided by them. This encompasses, but is not limited to, losses of profits, goodwill, data, use of the service, business interruption, inaccurate results, cost of recovering any data, cost of claims by third parties for damages to electronic devices and software, or other intangible losses. To the fullest extent permitted by law, ZeFitBlad will not be liable to you or any third party. You and ZeFitBlad are precluded from initiating any legal action more than one year after the event that caused the cause of action. The exclusion of damages is a fundamental element of the agreement between you and ZeFitBlad. You agree to absolve ZeFitBlad from any liability related with any dispute between you and ZeFitBlad.

14. INDEMNIFICATION

    You are obligated to defend and indemnify and hold harmless ZeFitBlad, subsidiaries, and their respective members, directors, co-branders, officers, employees, agents, content licensors, for any violations of these Terms of Use and against any claims, expenses, damages, suits, costs, demands, including attorney’s fees, and/or judgments made by a third party arising from your improper use of the Site Offerings. This includes the violation of copyright or privacy rights, breach of this Agreement, any dispute between you and ZeFitBlad, and/or violation of the rights of another individual or entity. These provisions extend to the benefit of ZeFitBlad, its parents, subsidiaries, and affiliates, as well as their respective officers, directors, members, employees, agents, shareholders, licensors, suppliers, and attorneys, each of whom can directly enforce these provisions against you. It's important to note that merely viewing content does not confer any ownership rights, and posting information or material through the site offerings does not imply the waiver of any such rights. All rights not expressly granted in this Agreement, belonging to ZeFitBlad or its licensors, are retained by ZeFitBlad and its licensors

15. DISPUTE RESOLUTION

    The Agreement will be deemed as if it were executed and performed in United Kingdom and will be governed by and construed in accordance with the laws of United Kingdom (excluding conflict of law principles). If you have filed a complaint with ZeFitBlad and find the response unsatisfactory, you have the option to initiate arbitration for resolution through a Settlement Offer. The arbitration process will take place in United Kingdom and will be overseen by a single arbitrator. Unless expressly mandated by applicable law, each party will be responsible for their respective legal costs, regardless of the arbitration outcome. While ZeFitBlad may have the entitlement to seek attorneys' fees and expenses if successful in arbitration, they will not pursue these from you unless the arbitrator determines that your claim was frivolous.

    Moreover, to the extent permitted by law, you commit not to initiate, join, or participate in any class action lawsuit pertaining to any claim, dispute, or controversy against ZeFitBlad and/or its employees, officers, directors, members, representatives, and/or assigns. You agree to the issuance of an injunction to halt such legal proceedings or to exclude you from involvement in the lawsuit. Additionally, you consent to covering the legal fees and court expenses incurred by ZeFitBlad in pursuing such relief. This provision, which prohibits your initiation, joining, or participation in class action lawsuits which does not relinquish any of your rights or remedies to pursue an individual claim and not as part of a class action in binding arbitration, as outlined above and/or constitutes a distinct agreement.

16. NOTICE OF COPYRIGHT VIOLATION

    If you suspect that your copyrighted work has been violated, you can issue a copyright infringement notice to ZeFitBlad. This notification should include your contact details - phone number, email address and address, a signature from the copyright owner or an authorized representative, confirming their authorization, information in detail about the copyrighted work in question (including its location on the service) and an assertion of your good faith belief that the work is being used without lawful authorization, accompanied by a confirmation of the accuracy of the provided details.

17. MISCELLANEOUS

    17.1 Final Provisions

    This Agreement supersedes over any inconsistent or conflicting provisions related to our Services. No agency or partnership is established between the parties through this Agreement. If any part of this Agreement is deemed invalid or unenforceable, it will not impact the validity and enforceability of the remaining provisions, and it will be construed in accordance with applicable law. ZeFitBlad retains the right to transfer its rights and obligations under this Agreement to any third party at any time without prior notice. The headings in this Agreement are provided for reference only and do not elucidate, limit, or define any section.

    17.2 Modifications

    Finally, you acknowledge that this Agreement as well as the Billing Provisions are subject to revision at any time without further notice to you. The new Agreement and/or the revised Billing Provisions will be posted to our Services and by continuing using our Services, you agree that you accept, and you are bounded by all revised applicable terms. Otherwise, you may cancel your Membership according to the cancellation provision.

    17.3 External Links

    Our Services may contain advertising links to other websites operated by third parties. You acknowledge that ZeFitBlad does not have control over the information, products, or services provided on these external websites, bears no responsibility or liability for their content and operations and/or any losses or damages due to your usage of these links and you are responsible for any risks regarding your navigation to these links.

    17.4 Opt-Outs

    You have the option to opt-out of certain communication and marketing emails from ZeFitBlad by clicking the “unsubscribe” link located at the bottom of the notification emails or by contacting the Customers Support Team although you acknowledge that you are not able to opt out from transactional communication such as billing and service emails.

    17.5 Force Majeure

    Neither party shall have any liability under or be deemed to be in breach of this Agreement for any delays or failures in performance of this Agreement which result from force majeure; an event or sequence of events beyond a party’s reasonable control (which could not reasonably have been anticipated and avoided by a party) preventing or delaying it from performing its obligations hereunder, including without limitation war, revolution, terrorism, riot or civil commotion, or reasonable precautions against any such; strikes, lockouts or other industrial action, whether of the affected party’s own employees or others; blockage or embargo; acts of or restrictions imposed by government or public authority; explosion, fire, corrosion, flood, natural disaster, or adverse weather conditions. Force Majeure does not include a lack of funds.
